DESIGN, INC. BY USING DOWHNHOME WEB DESIGN, INC. SERVICES, YOU AGREE TO BE
BOUND BY THE TERMS AND CONDITIONS AND THESE GUIDELINES.
If at any time after activation of your account for DownHome Web Design,
Inc. Services, you do not agree to be bound by these Guidelines, the Terms
and Conditions, you should immediately end your use of DownHome Web
Design, Inc. Services. DownHome Web Design, Inc. may change these
Guidelines and the Terms and Conditions at any time. Such changes and
their effective date will be posted on the DownHome Web Design, Inc.
website at www.dhwd.com and/or DownHome
Web Design, Inc. will attempt to notify you of these changes through other
means. You agree to review changes to these Guidelines, the Terms and
Conditions and if any change is not acceptable to you, you agree to
terminate your use of DownHome Web Design, Inc. Services. Your continued
use of DownHome Web Design, Inc. Services after the effective date of any
such change constitutes acceptance of all of the changes.
1.0 General
While DownHome Web Design, Inc. encourages and supports the free flow of
information and ideas over the Internet, we expect that our customers and
users will act legally, responsibly and be considerate of others. DownHome
Web Design, Inc. reserves the right, but does not bear the responsibility,
to prohibit or delete any conduct, communication or content which DownHome
Web Design, Inc., in its sole discretion, determines to be unlawful or
harmful to others. When you are using DownHome Web Design, Inc. Services,
You are subject to these Guidelines and Terms and Conditions. DownHome Web
Design, Inc. may suspend or terminate your account at any time for any
reason (including, without limitation, if DownHome Web Design, Inc.
determines that you have failed to comply with these Guidelines or the
Terms and Conditions).
As DownHome Web Design, Inc. does not monitor conduct of end users nor
communication or content distributed through its services, you acknowledge
DownHome Web Design, Inc. is unlikely to be aware of violations of law or
these Guidelines or other misconduct by end users occurring through use of
the DownHome Web Design, Inc. Services. As the sender of e-mail or poster
to a newsgroup, you bear full responsibility for the material you send
and/or post. As the recipient of e-mail or newsgroup postings, you are
responsible for using reasonable efforts to screen unwanted material and
reporting any offensive or illegal communications to DownHome Web Design,
Inc.
2.0 Prohibited Uses of DownHome Web Design's'

Unlawful purposes. Transmission, distribution or storage
of material or conduct in violation of any applicable local, state,
federal or foreign law or regulation is prohibited. This includes, without
limitation, any unauthorized use of material protected by patent,
copyright, trademark or other intellectual property right or material that
is obscene, constitutes an illegal threat, or violates export control
laws.

Unwanted Materials, Offensive Content and Disabling Code.
Transmission, distribution or storage of unwanted materials, offensive
content and disabling code is prohibited. This includes, without
limitation, pornographic images, materials or descriptions, viruses,
Trojan horse programs, messages which include character sequences intended
to control the recipient's computer or display screen, make-money fast
schemes, pyramid or chain letters, fraudulent offers, threats, harassment,
defamation, postings to a newsgroup in violation of its rules, charter or
FAQ and unsolicited advertising (whether commercial or informational).

SPAM. Sending e-mail that contains false or misleading
information to identify the sender or the subject matter or any form of
unsolicited e-mail ("SPAM") and all activities that have the effect of
facilitating SPAM, whether transmitted through the DownHome Web Design,
Inc. network
or another Internet service, are strictly prohibited. This includes,
without limitation, sending SPAM to direct visitors to your website,
whether or not the messages are originated by you, under your direction,
or by or under the direction of a third party.

DownHome Web Design's Services Functionality. Any action to
bypass, defeat or disable, or conduct that facilitates bypassing,
defeating or disabling, any functionality of the DownHome Web Design, Inc. Services
or alters the look and feel of DownHome Web Design, Inc. Web sites or user
interface is prohibited. This includes, without limitation, altering or
blocking the display of any advertisement, banner or other promotional
materials appearing on DownHome Web Design, Inc. Web sites or through the use of DownHome
Web Design, Inc. Services.

System and Network Security.
Any violations of DownHome Web Design, Inc. system or network security are strictly prohibited. Security
violations include, without limitation: (i) attempts to compromise the
security of any Internet account or website; (ii) altering the header
information of e-mail or postings or other activity that conceals
Your e-mail address or prevents recipients from responding to e-mail
messages You send; (iii) interference with service to any user, hosting or
network provider (including, without limitation, mail-bombing or
news-bombing, flooding, overloading a system, broadcast attacks,
disrupting Internet relay chat channels or newsgroups); (iv) use or
distribution of tools designed to compromise security (including without
limitation cracking tools, network probing tools, and password or credit
card, and other guessing programs) of any computer system or network; (v)
transferring excessive amounts of data through DownHome Web Design, Inc. network;
(vi) misuse or abuse of account access and passwords; and (vii) reselling
any aspect of DownHome Web Design, Inc. Services. |

3.0 Enforcement
In order for DownHome Web Design, Inc. to comply with applicable laws,
including without limitation the Electronic Communications Privacy Act 18
U.S.C. 2701 et seq., to comply with appropriate government requests, to
operate DownHome Web Design, Inc. systems properly, or to protect DownHome
Web Design, Inc. and/or its customers, DownHome Web Design, Inc. may
access and disclose any information including, without limitation, the
user names of DownHome Web Design, Inc. account holders, the contents of
any personal electronic communications passing through its network, and
any other information it considers necessary or appropriate. DownHome Web
Design, Inc. will cooperate with law enforcement authorities in
investigating suspected violations of these Guidelines and illegal
activity. DownHome Web Design, Inc. reserves the right to report to law
enforcement authorities any suspected illegal activity of which it becomes
aware.
If DownHome Web Design, Inc. receives a complaint or otherwise becomes
aware of any possible violation of these Guidelines or the Terms and
Conditions, DownHome Web Design, Inc. may, in its sole discretion,
initiate an investigation. This investigation may include gathering
information from and about DownHome Web Design, Inc. account holders and
examining the content of electronic communications or DownHome Web Design's Web
page(s) on DownHome Web Design's servers. During an investigation, DownHome Web
Design, Inc. may suspend DownHome Web Design, Inc. Services and/or remove
materials from its servers. You agree to cooperate with any such
investigation.
If DownHome Web Design, Inc. determines, in its sole discretion, that a
violation of these Guidelines, the Terms and Conditions or the License
Agreement has occurred, DownHome Web Design, Inc. may, but will not be
obligated, to take any or all of the following actions in addition to
legal remedies it may have available: temporarily or permanently remove
material from DownHome Web Design's servers, discontinue access to newsgroups,
cancel newsgroup postings, move postings to another forum,
warn the account holder(s) involved, remove e-mail sent by you, suspend or
terminate account(s) for DownHome Web Design's services, remove or deny access
to DownHome Web Design, Inc. personal web page(s) hosted on DownHome Web
Design, Inc. servers, publicly disclose the originating address, subject
matter and/or URL of the website associated with a prohibited transmission
and to charge a handling fee associated with taking such action and take
other responsive action at any time and for any reason. Violations of
these Guidelines could also subject You to criminal or civil liability.
